Der 72. Deutsche Juristentag hat im Jahre 2018 empfohlen, für das Personengesellschaftsrecht ein eigenes Beschlussmängelrecht nach dem Vorbild der §§ 241 ff. AktG gesetzlich einzuführen. Die Publikation befasst sich mit der Frage, ob das aktienrechtliche Beschlussmängelsystem bereits de lege lata nicht nur in der GmbH, sondern in allen rechtsfähigen Verbänden des Privatrechts gilt. Ausgangspunkt dieser Frage ist, wie der Beschluss privatwirtschaftlicher Zweckverbände dogmatisch einzuordnen ist und auf welche Weise er zustande kommt. Die Autorin arbeitet für die Beantwortung dieser Frage die historische Entwicklung des Beschlussrechts auf.

Economic repression became a keystone of the social exclusion policies of the Franco dictatorship from the stage of the coup dʼétat. Beyond its utility in provisioning the warfronts and for the proper functioning of the rearguard, it became a valuable deterrent and a weapon of intimidation that smothered any expression of non-conformity. If its efficiency was so remarkable, this was due to the fact that it did not act in an isolated fashion, but projected itself on the social body that had already suffered the combined effects of the Civil War, the physical repression and the rest of the coercive and social control mechanisms employed by the regime.

The book analyses contemporary relations between two biggest states in East-Central Europe: Poland and Ukraine. This topic is of interest for three reasons: difficult history of the two countries, different models of development adopted after the end of communism and the common challenge of aggressive Russian policy. The timeframe of the work is from 1989-2018, with an emphasis on the period after 2014, when the Russian-Ukrainian war began. The book is divided into three parts. The first part discusses the history and determinants of Polish-Ukrainian relations. The second one presents political, economic, social and military relations between the two states. The last part focuses on more specific issues such as historical memory, the Polish-Ukrainian border and relations with the EU.

Each of the chapters offers a glimpse of interesting research possibilities that practice raises, the issues we need to investigate and explain, as well as how to turn some of this research into practical action.

The book proves that dictionaries continue to play an important part in our daily and academic lives, though it is not always clear how they should fit into the overall pattern of curriculum design, teaching materials or learning styles.

Seit das «Ende des Kommunismus» auf 1990 festgeschrieben und der «Unrechtsstaat DDR» der Justiz übergeben wurde, inszenieren neue Institutionen, Stiftungen und Behörden auf Bundesebene den ökonomischen, kulturellen und moralischen Erfolg des Rechtsstaates. Dabei wird die Mehrheit der Neubürger mit Schockereignissen des krassen sozialen Wandels und der gesellschaftlichen Stigmatisierung konfrontiert. Konzepte wie «Transformation», «Modernisierung» und «Demokratisierung» treten als Euphemismen auf, die über eine neoliberale Annexion des Ostens hinwegtäuschen. Das Investmentprojekt «Aufschwung Ost» ist ein Laborfall der Globalisierung. Über eine Aufarbeitung der DDR im Totalitarismus- und Diktaturenvergleich hinaus ist eine Soziologie der Landnahme, des Gesellschaftsumbaus und des strukturellen Kolonialismus in Ostdeutschland längst überfällig. Das Forschungsprogramm «Entkoppelte Gesellschaft. Liberalisierung und Widerstand in Ostdeutschland seit 1989/90. Ein soziologisches Laboratorium» will im dreißigsten Jahr der «Einheit» diesem Thema mit einer mehrbändigen Publikation Rechnung tragen.

Der Band «Umbau» analysiert das Einrücken der Gesetzeskraft des Kernstaates in das Beitrittsgebiet und belegt die Vollstreckung und Verwerfung der ostdeutschen Gesellschaft. Entgegen herrschender Meinung wurde die Ermächtigung für die Übernahme der DDR durch die BRD nicht von der DDR-Bevölkerung erteilt. Der vorliegende Band leitet die Zusammenhänge einer bis heute wirkenden Kulturkatastrophe her, deren Aufarbeitung erst am Anfang steht.

Local Categories and Practices in a Guatemalan Highland Community

In this book, the author introduces belonging from a sociolinguistic perspective as a concept that is accomplished in interaction. Belonging can be expressed linguistically in social, spatial and temporal categories – indexing rootedness, groupness and cohesion. It can also be captured through shared linguistic practices within a group, e.g. collectively shared narrative practices. Using conversation analysis and an analysis of narrative as practice bolstered with ethnographic knowledge, the author shows how belonging is tied to locally contextualized use of deictics and to collectively shared narrations of the past in a Guatemalan community. The book examines the understudied phenomenon of belonging at the intersection of pragmatics and linguistic anthropology.

The essays examine the concept of utopia in a variety of contexts, such as philosophy, translation, music, social and political issues, like workers’ movements and ideology, exploring global utopian fiction from medieval Persian poetry, through late 19th- and early 20th-century narratives, to contemporary Russian and British dystopian novels. Taken together, the texts attest to the lasting allure of the hopeful utopian visions as well as to the pertinence of the dystopian warnings contained in the darker fictive scenarios and social speculations.
