Constitutional Courts in Post-Soviet States

Between the Model of a State of Law and Its Local Application

In the book, authors from eleven post-communist countries analyse the specific legal and political character of the organs of the control of law constitutionality in post-Soviet states. This is done through explaining the legal and political character of those bodies as well as their place in the system of the state power. The authors also examine tasks assigned to those bodies, the manner of their establishment, the course of their work, the legal force of their decisions and the legal status of their members. In the conclusions, the authors refer to the optimisation of the political status of the organs controlling the constitutionality of law as organs of the protection of the constitution.

Research findings, conclusions and recommendations formulated in the book can be applied with a view to changing the mechanisms of the protection of constitutionality in post-Soviet states or presenting lawmakers in other countries with consequences of adopting particular legal solutions.

Comparing Canada and the Americas: From Roots to Transcultural Networks covers the Americas in a comparative perspective spanning from the 19th century to the 21st century. It explores socio-cultural dynamics changing considerably in the Americas, which are progressively shedding their original fascination for Europe and slowly recognizing the importance of Indigenous, Afro-descendants, and immigrant cultures. The Americas have many dynamics in common, such as the presence of shared dualistic paradigms, like civilization/barbarism, which is a synonym for self/others. From the invention of the Nation States to globalization, the valorization of taking roots has transformed into the valorization of the legitimacy of geo-symbolic displacements. A comparative study of Canada, Quebec, Latin America, the Caribbean, and the USA reveals both the exclusions and the inclusions that, in literary, artistic, and media productions as well as political essays, are founded on the opposition between interior and exterior. The current era has seen the displacement of these oppositions within the context of the recognition of the others. This recognition is rooted in multicultural, intercultural, and transcultural perspectives. In the current networked and complex contemporary world, literary, artistic, political, and media texts go beyond dichotomous oppositions and historical master narratives legitimating exclusions. Instead, they valorize "chameleoning" and the surprise of encounters with different cultures, thus creating new perspectives linked to a techno-cultural and democratic future based on the desire to share and to belong to oneself.

Die Studie rekonstruiert diese und untersucht Verwendungen sprachlicher Formen bei Jugendlichen aus der Region Trier empirisch anhand einer dreigliedrigen Leitfrage: Wie wird der Sprachraum von Sprechern mit alltagssprachlichen Termini strukturiert, wie sind davon ausgehende Spracheinstellungen zur Nonstandardverwendung sozial verteilt und wie wird vor diesem Hintergrund Sprachvariation zur Strukturierung von Mikrosituationen verwendet? Die Thematik wird mittels eines Mixed-Methods-Designs und die zentrale Analysekategorie »semantischer Raum« erschlossen.

Konflikte sind ein zentrales gesellschaftliches Phänomen, das zu jeder Zeit menschlichen Seins relevant war und ist. Entsprechend zentral für eine Gesellschaft ist der Wortschatzbereich, der diesen Ausschnitt sozialen Verhaltens erschließt. Der Autor untersucht die inhaltlichen Strukturen dieses Wortschatzbereiches der deutschen Sprache im frühen Mittelalter auf der Basis eines wortfeldtheoretischen Ansatzes. Ersichtlich wird, dass noch im frühen Mittelalter eine enge Beziehung des Konfliktwortschatzes zum Rechtswortschatz bestand. Es zeigt sich, dass Konfliktlexeme über regionale und dialektale Grenzen hinweg weitgehend Allgemeingut waren. Mit der neuen christlich-jüdischen Theologie sowie mit den Veränderungen in Kriegsführung und Militärwesen deutete sich zudem ein Bedeutungswandel bei Feldgliedern und damit im Wortfeld an.

Buffers beyond Boundaries

Bridging theory and practice in the management of historical territories

What is a buffer? Is it a control zone? Or is it rather a transition space, a blurred boundary? Since "buffer zones" were introduced in the late 1970s as a complementary protection layer to World Heritage sites, the dimensions of heritage have changed significantly; from physical to intangible, from defined to diffused. Now, buffers can present all these different characters, even at the same time.

Using buffers as the main connection thread, this book is a collection of complementary studies that explore the contemporary challenges in heritage definition and management. With a focus on European and Asian historical territories, this book tracks umbrella terms, from their genesis inside international discussions and cultural exchanges, to their specific interpretation in top-down on-site strategies. Then, it originally complements and verifies these official management models with the study of local realities and parallel bottom-up actions that have emerged to fill major gaps in this system. With this, the book underlines the negative impacts of isolated biased strategies, and addresses the call of local intermediate groups and communities for integrated efforts.

Finally, buffers are presented as an intermediate heritage management model that could help integrate both, protection and development, territorial and community scales.

Pharmakologische Neuroenhancer üben eine große Anziehungskraft auf die Menschen aus. Diverse Studien und zwei vom Autor selbst durchgeführte Umfragen kommen zu dem Ergebnis, dass der Konsum in den letzten Jahren drastisch anstieg und die Bereitschaft zur Einnahme entsprechender Substanzen auf einem hohen Niveau ist. Der Autor zeigt auf, dass das Recht keine maßgeschneiderte Lösung für den Fall bereithält, dass Gesunde ihre mentalen Fähigkeiten durch Medikamente steigern. Deshalb nimmt der Autor eine dezidierte rechtliche Analyse vor, um für den Umgang mit Neuroenhancement einen verlässlichen normativen Rahmen zu entwickeln. Sämtliche Darstellungen bilden die Grundlage dafür, dass der Autor im letzten Abschnitt einen Gesetzesentwurf entwickelt und dessen Auswirkungen würdigt.
