Die EU-Richtlinie über die Vergabe öffentlicher Aufträge enthält erstmals Vorgaben zu „Life Cycle Costing". Die Autorin befasst sich mit der Frage, ob und wie das Instrument des „Life Cycle Costing" einen Beitrag zu einer nachhaltigen öffentlichen Auftragsvergabe durch die Berücksichtigung ökologischer und sozialer Ziele leisten kann. Dabei analysiert sie das europäische Richtlinienrecht und das nationale Umsetzungsrecht sowie die primärrechtlichen Grenzen. Sie überprüft die Voraussetzungen, die das Vergaberechtsregime an „Life Cycle Costing" Methoden stellt und bewertet diese im Hinblick auf den Einsatz im Rahmen des Zuschlags. Anschließend entwickelt die Autorin wertvolle Vorschläge hinsichtlich der Gewichtung der Ergebnisse eines Life Cycle Costing in der Zuschlagsentscheidung.

Museums go International

New strategies, new business models

Museums are increasingly developing international strategies to raise their profiles outside of their home markets. How can we define this trend? This book is based on a multiple correspondence analysis of a database populated by the results of a survey conducted by the author on international museums. The study reveals that museums fall into four categories regarding their internationalization strategies and can have two complementary international strategies: one geared toward economic profitability and one geared toward the preservation of heritage. However, traditional business models for museums are currently facing challenges from a decline in public subsidies, uncertainty surrounding private donations and stagnant ticket sales. The author argues that the internationalization of museums is having an impact on the historical models and is contributing to the evolution of these business models. Two case studies, of the Victoria & Albert Museum (London, UK) and the Musée des Arts et Métiers (Paris, France), provide particular insights into the international characteristics and practices of museums.

Sie erörtert welche Erscheinungsformen von Prozessverträgen im US-Recht bereits etabliert sind und wie Staats-, Partei-, Öffentlichkeits- und Drittinteressen in einen angemessenen Ausgleich gebracht werden.

The 2018 edition of the Conference took place under the title "The Romanian Economy. A Century of Transformation (1918-2018)", as part of the Romanian Academy anniversary events celebrating the "100th anniversary of the Great Union of Romania".

The second part of the book consists of six sub sections about the banking sector that is fundamental to the economic structure and the main actor of the financial sector. This main sector discusses the efficiency and performance of the banking sector and also shadow banking. In addition, the banking sector is analysed in the Islamic banking area. Furthermore, the interaction of the banking sector and technological developments are emphasized in a separate section in this part.

Buffers beyond Boundaries

Bridging theory and practice in the management of historical territories

What is a buffer? Is it a control zone? Or is it rather a transition space, a blurred boundary? Since "buffer zones" were introduced in the late 1970s as a complementary protection layer to World Heritage sites, the dimensions of heritage have changed significantly; from physical to intangible, from defined to diffused. Now, buffers can present all these different characters, even at the same time.

Using buffers as the main connection thread, this book is a collection of complementary studies that explore the contemporary challenges in heritage definition and management. With a focus on European and Asian historical territories, this book tracks umbrella terms, from their genesis inside international discussions and cultural exchanges, to their specific interpretation in top-down on-site strategies. Then, it originally complements and verifies these official management models with the study of local realities and parallel bottom-up actions that have emerged to fill major gaps in this system. With this, the book underlines the negative impacts of isolated biased strategies, and addresses the call of local intermediate groups and communities for integrated efforts.

Finally, buffers are presented as an intermediate heritage management model that could help integrate both, protection and development, territorial and community scales.

Pharmakologische Neuroenhancer üben eine große Anziehungskraft auf die Menschen aus. Diverse Studien und zwei vom Autor selbst durchgeführte Umfragen kommen zu dem Ergebnis, dass der Konsum in den letzten Jahren drastisch anstieg und die Bereitschaft zur Einnahme entsprechender Substanzen auf einem hohen Niveau ist. Der Autor zeigt auf, dass das Recht keine maßgeschneiderte Lösung für den Fall bereithält, dass Gesunde ihre mentalen Fähigkeiten durch Medikamente steigern. Deshalb nimmt der Autor eine dezidierte rechtliche Analyse vor, um für den Umgang mit Neuroenhancement einen verlässlichen normativen Rahmen zu entwickeln. Sämtliche Darstellungen bilden die Grundlage dafür, dass der Autor im letzten Abschnitt einen Gesetzesentwurf entwickelt und dessen Auswirkungen würdigt.

In den letzten Jahren sind immer mehr Private an der Erbringung der öffentlichen Dienstleistungen beteiligt. Allerdings ergibt sich in der Praxis daraus, dass die Daseinsvorsorge nicht blind auf einen reinen Wettbewerb vertrauen kann. Der öffentliche Personennahverkehr kann als ein gutes Beispiel dienen. Es stellt sich die Frage, wie die Erbringung der öffentlichen Dienstleistungen so organisiert werden kann, dass einerseits ein fairer Wettbewerb zwischen Unternehmen entstehen kann, andererseits die sozial- und arbeitsmarktpolitischen Belange berücksichtigt werden können. Um diese Frage zu beantworten, analysiert der Autor nicht nur staatsrechtliche und europarechtliche Entwicklung, sondern führt die Regulierung als ein Handlungskonzept der Verwaltung im Recht des ÖPNV ein.
