Die Arbeit widmet sich der Untersuchung der Möglichkeiten und Grenzen des Anwendungsbereichs der umsatzsteuerlichen Organschaft nach § 2 Abs. 2 Nr. 2 UStG mit besonderem Fokus auf die europäische Einflussnahme. Die Verfasserin setzt sich dabei zunächst mit dem Status Quo dieser Organschaftsregelung sowie mit den zu berücksichtigenden unionsrechtlichen Vorgaben des Art. 11 MwStSystRL auseinander. Im weiteren Verlauf der Arbeit zeigt die Verfasserin unionsrechtliche Defizite des umsatzsteuerlichen Organschaftsmodells auf. Abschließend werden dem deutschen Gesetzgeber im Rahmen eines Gesetzesvorschlags Implikationen für die Weiterentwicklung des Anwendungsbereichs der umsatzsteuerlichen Organschaft an die Hand gegeben.

At the heart of Communication and Critical Cultural Studies is a discipline that has been slowly expanding its borders around the issues of racism, sexism, ability, privilege, and oppression. As Latinx, African American, Asian Pacific American, Disability and LGBTQ Studies widen and shift the scope of Communication Studies, what often gets underplayed is the role of transnational Middle Eastern and North African (MENA) Studies. It is imperative that the experiences of transnational individuals who live and move between the region and the U.S. are centered. For this reason, the goal of this book is to begin to bring Middle Eastern and North African Communication and Critical Cultural Studies in conversation with Global and Transnational Studies. We ask, how can scholars make a space for transnational MENA Studies within Communication and Cultural Studies? What are the pressing issues? Thus, at a time where Arabs, Arab Americans, Iranians, and Iranian Americans are under attack by Western media and governments, it is crucial to center their voices from a transnational perspective that privileges their positionalities and experiences rather than continue to study them from a reductive Eurocentric lens. We seek to build on existing scholarship by including essays that theorize from a Communication and Critical Cultural Studies lens. This book aims to bring together work by established and new or emerging scholars.

Negotiating Identity and Transnationalism is suitable for academic researchers, scholars, students and activists in the fields of critical performative studies, cultural studies, rhetoric, feminist studies, queer studies, intercultural studies, social justice and media studies. The book can be taught in classes such as Media & Society, Intercultural Communication, Intersectional Feminism, Cultural Studies, Rhetoric and others.

Nietzsche and the Buddha

Different Lives, Same Ideas (How Nietzsche May Yet Become the West’s Own Buddha)

This book examines Nietzsche’s claim that he could be the "Buddha of the West." A close reading of his texts shows substantial similarities with the Buddha’s teachings, suggesting a potential basis and a potentially promising future for a Western Buddhism that would be based on Nietzsche’s philosophy. The book first provides a brief comparative biography of Nietzsche and the Buddha and then a review of the Buddha’s Four Noble Truths and the Noble Eightfold Path and of what there is in Nietzsche’s writings that is his equivalent to those teachings.

While the West often looks to neuroscience to validate the Buddhist teachings and practices, this book suggests it would be better to study Nietzsche’s thought to discover not only validation for Buddhist teachings but the very foundation of a "Buddhism" that is of the West, by the West, and for the West.

The work is based on the quantitatively and qualitatively rich source material, which formed the basis for considerations from the perspective of social history, music analysis and aesthetics. Thanks to these multiple perspectives, as well as the time range and the source base, this study may contribute to the history of the reception of Chopin’s work in nineteenth-century culture; it may also prove significant in overcoming the attitude that aesthetically deprecates transcriptions and in adopting a different stance, regarding such adaptations as valuable texts of musical culture.

The overall financial market environment has undergone a dramatic shift in the past few years as a result of the recent global financial crisis, associated regulatory changes, and new market participants. This study undertook an online survey of 12,169 SMEs from all major sectors of the German economy. A total of 576 completed and usable questionnaires were collected. The aim of this study is to explore the nature of lending relationships in light of the past financial crisis, the resultant structural changes, and the competition of new entrants into the financial system. The study shows that relationship lending is essential for ensuring financial market stability.

Das Opfer im Strafverfahrensrecht

Zwischen europäischem Mindestschutz und deutschem Gestaltungsspielraum

Der deutsche Gesetzgeber ist der Ansicht, mit dem 3. Opferrechtsreformgesetz die seitens der EU vorgegebenen europäischen Mindeststandards, wie sie sich aus der Opferschutzrichtlinie 2012/29/EU ableiten lassen, ausreichend umgesetzt zu haben. Der Autor kommt zu dem Ergebnis, dass dies nicht der Fall ist. Der deutsche Gesetzgeber hat die Tragweite dieser Mindeststandards, für die vereinzelt auch die Rechtsprechung des EGMR zur Auslegung der EMRK heranzuziehen ist, zumindest teilweise verkannt. Dieses Ergebnis wird von einer umfassenden Würdigung der deutschen Rechtslage zu den Opferrechten im Strafverfahrensrecht getragen, bei der auch verfassungsrechtliche und straftheoretische Erwägungen nicht zu kurz kommen, um den rechtspolitischen Nachholbedarf zu umreißen.

Die Untersuchung bietet die erste Bestandsaufnahme eines bemerkenswerten Phänomens des politischen Gegenwartstheaters: In den Spielzeiten 2012/13 bis 2017/18 wurden 25 Theatertexte uraufgeführt, die sich mit der Verbrechensserie der Terrorgruppe ‚Nationalsozialistischer Untergrund‘ (NSU) befassen. Sie reagieren damit auf Leerstellen der politischen, gesellschaftlichen sowie juristischen Aufarbeitung des NSU. Die Studie untersucht ausgewählte prototypische Theatertexte von Elfriede Jelinek bis Nuran David Calis und deren Inszenierungen. Der Fokus auf Zeugenschaft als Analyseperspektive verbindet Fragen der Darstellung, wie jene von Angehörigen der Opfer oder von TäterInnenfiguren, mit Fragen der Rezeption von TheaterzuschauerInnen.
