During intra-regional exchanges in the Indian Ocean, the companies have to face various barriers, tariff and commercial. A new obstacle can be added when the company is in difficulty. On the one hand, the disparities of the national laws on the matter can doubtless constitute brakes. First of all, they do not offer necessarily the same security to the company in difficulty. Moreover, the partners of these companies necessarily do not profit from the same warranties. In addition, the presence of international elements giving to the procedure of insolvency a transnational dimension causes important difficulties because of existence of conflicts of laws.
