8 English Abstract
This thesis deals with the contract practice prevailing in the international grain and feed trade. Particular focus has been given to the investigation of the Eng- lish contracts issued by GAFTA which are also in Germany almost predomi- nantly used for cross-border transactions with agricultural commodities. First of all, this paper investigates to what extent the regulations of the contracts enjoy – due to their level of details – a certain kind of autonomy vis-à-vis the legal sys- tem of the state. In addition, the respective contract clauses will be commented on in detail and each clause will be examined with respect to its importance for overseas purchase transaction and its manner of interpretation in English prac- tice. Attention will be drawn on snares and the need for more comprehensive individual agreements. Furthermore, the individual clauses will be compared with the United Nations Convention on Contracts for the International Sale of Goods (CISG) and the German contract practice in the grain and feed trade and its contracts. Differences and similarities will be identified. In doing so, this paper closes a gap in German literature on the practice of English overseas purchase transactions involving GAFTA contracts. Up to date, the GAFTA contracts fail to have been illuminated from a German point of view. Only some English discourses as well as a French essay of 1928 have been written by now.
