Abstract: Unlike the previous Hungarian Constitution, the new Basic Law of Hungary contains several references to God, to Christianity and to the Christian churches. This essay analyses the religious neutrality and the Christian contents of the Basic Law. Whereas the freedom of religion and the religious neutrality of the state are part of the ‘strict constitutional law’, i.e. belong to the normative text of the Basic Law, the references to Christianity and Christian churches serve more as a historical framework of Hungary’s present identity and therefore are symbolic rather than normative.
