Zusammenfassung

This book grew out of the sixth annual meeting of the Platform of Experts in Planning Law held in Lisbon in October 2012. The book’s chapters illustrate the evolution of this unique comparative land use planning and regulation forum. They allow a broader audience to benefit from the insights gained from the national case studies presented at the Lisbon meeting on the issue of Privatisation of Planning Powers and Urban Infrastructure.
Diese Veröffentlichung entstand aus dem sechsten Expertentreffen für Planungsrecht, das im Oktober 2012 in Lissabon stattfand. Die einzelnen Kapitel illustrieren die nationale Entwicklung im Planungsrecht und stellen einen einmaligen Vergleich des Planungsrechts vor dem Hintergrund der Privatisierungstendenzen im Bereich der Stadtplanung und städtischer Infrastrukturen in den verschiedenen Teilnehmerländern dar.

I.  Introduction

Throughout history there has always been a clear distinction in the city-making process between the role of the Administration as a planner and manager of public infrastructures and spaces and the role of private entities as property developers and builders.

Following a general economic trend on privatization of public functions, in recent years we have seen private entities assuming more complex responsibilities concerning the planning and management of our cities. Not only providing services of general interest like public transportation or the supply of electricity, water and sewerage, but also drafting zoning plans, controlling property development and creating and maintaining urban infrastructures and public spaces.

The question is how far privatization of planning powers and urban infrastructures can go due to the political nature of the decisions involved. And more specifically, how can planning laws contribute to achieve a balance between economic efficiency and democratic legitimacy in city planning and management.

In view of this case study, the participants of the conference answered three questions concerning the correlation of planning and privatization.

Questions

I. Einleitung

Im Laufe der Geschichte der Stadtplanung gab es durchweg eine klare Unterscheidung zwischen der Rolle der Verwaltung als Planer öffentlicher Infrastruktur und öffentlicher Plätze und der Rolle privater Instanzen als Entwickler und Bauherr.

Dem globalen Trend der Privatisierung öffentlicher Aufgaben folgend, wurde in den letzten Jahren deutlich, dass private Instanzen mehr und mehr Verantwortung bezüglich der Planung unserer Städte übernehmen. So liegt in deren Aufgabenbereich nicht nur die Bereitstellung technischer Infrastruktur, wie ÖPNV, Strom- und Wasserversorgung sowie Abwasserentsorgung, sondern auch die Aufstellung von Bebauungsplänen, die Überwachung der Entwicklung von Eigentumsverhältnissen sowie das Schaffen und Erhalten städtischer Infrastruktur und öffentlicher Plätze.

Die Frage ist, wie weit Planung und urbane Infrastruktur in Hinblick auf die politische Natur der damit zusammenhängenden Entscheidungen privatisiert werden können. Und genauer, wie können Gesetze zu einem ausgeglichenen Verhältnis zwischen ökonomischer Effizienz und demokratischer Legitimation in Stadtplanung und Stadtverwaltung beitragen?

Im Hinblick auf diese Ausgangslage wurden den Tagungsteilnehmern drei Fragen zum Schnittfeld Planungsrecht und Privatisierung gestellt.

1.  Denmark

Introduction

Privatisation in Denmark has been part of political picture since the beginning of the millennium. One could argue that general legislative measures were the initial way of dealing with privatization, but in recent years two distinctive paths seem to be evident: Contestability of public works through cooperation with private contractors and deregulation especially launched as a Municipal Pilot Program stating regulatory relief in quite specific cases. The latter gives certain municipalities regulatory relief from the general legislation for a period of four years in order to analyze the effect.

1.1  Question 1

Is there legislation concerning the initiative and/or the drafting of zoning plans and other equivalent documents by private entities? What is the procedure in that legislation and does it guarantee municipal control of planning powers? How is public participation organized in this procedure?

Overview

Following the municipal reform in 2005 Denmark 271 municipalities were voluntarily merged into 98 and 16 counties were replaced by 5 regions. Although the reform ‘only’ transferred the planning powers of the county councils to the municipal councils the impact on the legal framework encompassing the planning system in Denmark was huge.1 Thus, the planning authorities are assigned the municipal councils and to a limited extend the regional councils.2 The Minister of the Environment is assigned ← 7 | 8 → limited powers of intervention and granted the possibility of acquiring the planning authority, when national interests are at stake.

Stephan Mitschang is professor of Urban and Regional Development – Local, Regional and Federal State Planning at the Department of Urban and Regional Planning at the Berlin University of Technology. Stephan Mitschang ist Universitätsprofessor am Fachgebiet Städtebau und Siedlungswesen – Orts-, Regional- und Landesplanung am Institut für Stadt- und Regionalplanung der Technischen Universität Berlin.
