Das Potential der Regel aus «Rylands v. Fletcher»

Gefährdungshaftung im englischen «Common Law of Torts»

Zusammenfassung

Im englischen Common Law of Torts, dem richterlichen Deliktsrecht, steht die Regel aus Rylands v. Fletcher für das Konzept einer verschuldensunabhängigen Gefährdungshaftung. Jedoch bevorzugen die Gerichte heute zunehmend verschuldensbasierte Haftungsmodelle – und beschneiden den Anwendungsbereich von Rylands empfindlich. Hiergegen wendet sich dieses Buch und erforscht das Potential von Rylands v. Fletcher als Instrument richterlicher Gefährdungshaftung. Aus der methodischen Perspektive des englischen Richters wird vor allem die Präjudizienlage untersucht. Hinzu tritt innerhalb des Common-Law-Rechtskreises ein Vergleich zur Rechtslage in Australien und den USA. Auf dieser Grundlage wird eine neu ausgerichtete, ihr Potential ausschöpfende Regel aus Rylands v. Fletcher formuliert.
