The papers collected in the present volume suggest that private property is not necessarily the most safeguarded legal model, hence it is not less vulnerable to violation. They construct a close analysis of the most common forms of abuse of private property on record – expropriation, seizure, and confiscation – perpetrated by public authorities. They also seek to define the uneasy, often intricate relation between legal and legitimate. In a perspective of lights and shadows, the role of confiscation and expropriation changes : now seen as powerful instruments of change, now as enduring factors of conservation in the evolution of private ownership rights.

Expropriation for Public Use : Construction of the Railway Line in Abruzzo Natascia Ridolfi The construction of the railway line in Abruzzo was made possible by the activity of expropriation The legal institution of expropriation has its principles in the Italian Constitution which on the one hand protects private propriety and on the other preserves the right of expropriation for the benefits of general interests1. This is considered as an unavoidable necessity of political, economic and social solidarity to which the citizen-owner is subject. This is recognised by compensation determined by the value of the land and by the profits it produces on the basis of the market2. The first act, which governs the expropriation proceedings related to the railway, was the Royal Decree no. 281 of 2 October 1861 issued with an adjoin- ing regulation, in occasion of the construction of the railway in the Napole- tane3 province, which proposed, among other things, the guidelines of the Preunitarian decree focusing on the realization of the railway in Apulia4. A general regulation on expropriation for public use was issued only in 1865 : Law no. 2359 of 25 June.
