On Human Rights Protection in the European Union Legal Order: Between Pragmatism and the Axiology of Integration
Abstract: The article indicates and analyses processes of Europeanisation which led to the specific situation of the human rights within the European legal order. On the one hand the normative and judicial aspects of human rights protection are an element of the constitutionalization of acquis communautaire (understood as establishing a coherent system of principal norms, which encompass traditional constitutional matter). On the other hand the processes of Europeanisation proceed in-between the pragmatic and axiological view of European integration. The articles unmasks and discusses processes which has led to forming this postmodern and multicentric junction-structure of the European Union.
