Prevention Act 2015 provides legislation, organisation, and services of health promotion and prevention appropriately, as it develops a health promoting overall policy. However, the regulating Federation has to respect the Constitution that splits powers between the Federation and the federal states, as well as the constitutional requirement for the distinctiveness of legal rules. Actually, the configuration of task responsibility of health insurance on the one hand and the Federation’s responsibility for organisation and finance on the other, has not been created in full accordance with the Constitution.
