This book grew out of the sixth annual meeting of the Platform of Experts in Planning Law held in Lisbon in October 2012. The book’s chapters illustrate the evolution of this unique comparative land use planning and regulation forum. III.  Privatization of Planning and Urban Infrastructure – Comparative Review

Question 1

The question of the existence of legislation concerning the initiation and/or drafting of urban land-use plans and other similar documents by private entities is linked to the practical adaptation of these tasks. A survey of the following countries showed that draft plans are drawn up by private entities.

Responses from the United States do not include any explicit statements on the existence of legislation that allows tasks relating to the process of initiating or drafting plans and other equivalent documents to be transferred to private entities. Such allocation, however, is permitted by legislation on public procurement procedures, in which urban land-use planning services are also included under ‘related services’.
